TECHWATCH B.V. – TERMS AND CONDITIONS

Please note: partners, sponsors and exhibitors can use your data for their own purposes, but only after you have given us permission to share your data with them.

Article 1.1: Definitions

The following definitions apply to these terms and conditions:

  1. Member: natural person or legal person with whom Techwatch has reached a membership agreement. Wherever the term member is mentioned, it can also be read as subscriber.
  2. Techwatch: publisher, Techwatch B.V., established in Nijmegen, who has issued the membership agreement as referred to under 1.4.
  3. Membership: legal relationship within which Techwatch commits itself to provide information to the member periodically, against a predetermined payment obligation that the member must meet at agreed times. Wherever membership is mentioned, it can also be read as subscription.
  4. Membership agreement: agreement between Techwatch and a member regarding a membership.
  5. Client: Third party that has signed an agreement with Techwatch.
  6. Bits&Chips: publication of Techwatch.
  7. Bits&Chips Basic membership: free membership of Bits&Chips.
  8. Bits&Chips Premium membership: paid membership of Bits&Chips, which includes full access to the articles on the Bits&Chips website during your membership.
  9. Bits&Chips Premium Plus membership: paid membership of Bits&Chips, which includes full access to the articles and video archive on the Bits&Chips website, and a discount code for events organised by Bits&Chips and / or High-Tech Systems Magazine.
  10. Bits&Chips Business membership: paid membership of Bits&Chips, which includes Premium Plus access for all accounts on your company e-mail domain.
  11. Bits&Chips events: events organized by Techwatch.

Article 1.2: General conditions

  1. Unless explicitly agreed upon otherwise, these Terms and Conditions apply to all membership agreements between Techwatch and members. By entering into a membership, the member agrees to these Terms and Conditions.
  2. The rights and / or obligations of the member cannot be transferred to a third party, unless previously agreed upon in writing with Techwatch.
  3. Techwatch reserves the right to unilaterally change these membership conditions. Changes to these Terms and Conditions take effect at the end of the current payment / membership period.
  4. Specific conditions have been defined for each membership type that the member must meet. These additional terms and conditions can be found in the relevant paragraph in this document.
  5. If it subsequently turns out that the member has not completed a membership application truthfully, Techwatch will send an additional invoice for the membership that does apply.

Article 1.3: Offer and acceptance

  1. Membership agreement of Basic, Premium and Premium Plus membership is concluded via the Bits&Chips website (My Account). Membership agreement of Business membership is concluded after confirmation by email by Techwatch.
  2. Techwatch is entitled to refuse a request to enter into a membership agreement without giving a reason.
  3. You can enter into your first membership agreement at any time throughout the year.
  4. Techwatch is entitled to change the scope, content and layout of the Bits&Chips publication at its own discretion, at any time, as long as Techwatch ensures that the publication stays reasonably and qualitatively in proportion to the membership rate after changes.

Article 1.4: Extension, cancellation and termination of agreement

  1. Membership applies until cancellation (unless stated otherwise) and for at least the agreed membership period.
  2. Membership will be tacitly extended after the first membership year, by 1 month for Premium and Premium Plus memberships, or 1 year for Business memberships, at the current membership price, unless you have canceled your membership before the stated notice period.
  3. Cancellation is not possible during the first year of membership.
  4. Cancellation can only be made via My Account or in writing by postal mail or e-mail at the end of the first period of the membership.
  5. Our notice period for Premium and Premium Plus memberships is 1 month. Our notice period for Business memberships is 1 year.
  6. Termination is approved after written confirmation is received from Techwatch by e-mail.
  7. In the event of the death of a natural person, their membership agreement will be terminated at the moment their passing away is notified to Techwatch.
  8. In the event of a member’s passing away, a refund of the membership fee is possible for the membership period that has not expired at that time. Reimbursement can only take place if there is an amount in excess of fifteen (15) euros.

Article 1.5: Pricing policy

  1. The legally applicable VAT rate applies to all membership types. Membership rates on the website and in the magazine include VAT, unless stated otherwise.
  2. Techwatch can adjust membership prices unilaterally, on an annual basis.
  3. Price increase for members starts after the end of the current membership period for which payment has already been made.
  4. If the shipment address where the Bits&Chips magazine should be delivered gives rise to additional costs, Techwatch is entitled to charge these costs to the member.

Article 1.6: Invoicing and payment

  1. Premium and Premium Plus members pay directly online for the first year of membership and automatically receive the corresponding invoice.
  2. Premium and Premium Plus members also issue a direct debit authorization to Techwatch during the payment for the first year. With this authorization, members give permission to Techwatch to automatically debit the membership rate from the member’s account for the upcoming membership years after the first year of membership until cancellation.
  3. If the member does not agree with this debit, the member can have the debit reversed. The member must contact the member’s bank within eight weeks after debit. The bank may impose conditions on a charge-back.
  4. Upon renewal, Techwatch automatically collects the membership fee prior to the month in which the membership will be renewed.
  5. Techwatch will send an advance notice by email at least three days before the membership fee will be collected.
  6. Each membership is invoiced separately by Techwatch to the member, unless the parties have agreed otherwise.
  7. If payment arrears arise, Techwatch is entitled to suspend (further) receipt of the Bits&Chips magazine and access to the Bits&Chips website (www.bits-chips.nl). Suspension of membership will never result in the member being relieved of his contractual (payment) obligations.
  8. The absence of an invoice as referred to in Article 1.6.1 or 1.6.2 does not lead to the lapse of any right. Techwatch may, within twelve (12) months after sending the invoice to the member, regardless of whether the invoice has already been paid, correct inaccuracies or other defects in the invoice and debit or credit the invoice in accordance with it.

Article 1.7: Delivery and addressing

  1. A member must inform us of a move at least three (3) weeks before the relevant date via My Account or by e-mail at info@techwatch.nl.
  2. Techwatch puts its utmost effort to having the magazine delivered on the agreed day. If the member has not received the magazine on time, he / she can report a complaint about the delivery to the membership department of Techwatch at info@techwatch.nl. Techwatch will then make every effort to deliver the magazine free of charge. This only applies to paid memberships for which payment has already been paid to Techwatch . As far as possible, this postal delivery will take place within one (1) week after the complaint has been submitted, provided that the complaint is submitted within two (2) weeks of the intended delivery date.
  3. Complaints regarding the delivery do not give the member the right to suspend the payment of the membership fee in whole or in part.
  4. Techwatch is in no way liable for any (consequential) damage that the member suffers or could suffer due to the magazine not being delivered or not delivered on time.
  5. The member is not entitled to a refund of part of the membership fee paid by him / her if the magazine is not delivered once or more by Techwatch or the shipping company concerned as a result of a force majeure situation that makes delivery impossible.
  6. Inaccuracies in the address or the name of the member can be changed in My Account or must be reported to Techwatch at info@techwatch.nl as soon as possible.

Article 1.8: General Data Protection Regulation (GDPR)

The (personal) data provided by the member to Techwatch is included in a database that is used for the implementation of the membership agreement, as well as for informing the member about relevant services and products from Techwatch, or third parties carefully selected by Techwatch. This will be done in accordance with the provisions of the General Data Protection Regulation (AVG) and the type of membership that has been entered into.

ADDITIONAL CONDITIONS PER MEMBERSHIP TYPE

Article 1.9.1: Bits&Chips Basic membership

  1. Bits&Chips Basic membership is intended for private individuals.
  2. Basic members receive the weekly digital Bits&Chips newsletter at the e-mail address provided when taking out membership.
  3. Basic members have access to news articles on the Bits&Chips website (www.bits-chips.nl) for up to 1 year.
  4. Basic members must complete the entire registration form.
  5. Once a year, Basic members must check their registration details in My Account for accuracy.
  6. Basic members agree to receive (e-)mailings from Techwatch, or third parties carefully selected by Techwatch.
  7. Bits&Chips Basic membership can be terminated by Techwatch at any time.
  8. There are no costs associated with Bits&Chips Basic membership.
  9. It is not possible for companies to take out a Bits&Chips Basic membership. As a company, you can only opt for the Bits&Chips Business membership.

Article 1.9.2: Bits&Chips Premium membership

  1. Bits&Chips Premium membership is intended for private individuals.
  2. The applicable membership rate for Bits&Chips Premium membership can be found on the Bits&Chips website (www.bits-chips.nl) and in the magazine.
  3. Members must complete the entire registration form.
  4. Bits&Chips Premium membership provides the benefits specified below, which are only valid if the personal data are entered correctly. If the information is incorrect, Techwatch is entitled to send an additional invoice.
  5. Members receive the printed magazine at the private address specified when taking out membership and/or receive the digital magazine at the e-mail address provided.
  6. Members receive a personal login to gain access to the complete article archive on the Bits&Chips website (www.bits-chips.nl).
  7. This login is strictly personal and may not be shared. Reasons for this are: 1) that the login serves for identification when logging in and 2) because the linked account contains personal data, such as information about the subscription and personal information about the subscriber (e.g. e-mail address and payment details).
  8. It is the member’s responsibility to submit a correct physical address and/or e-mail address available to Bits&Chips at all times.
  9. Once a year, members must check their registration details in My Account for accuracy.
  10. Members agree to receive (e-)mailings from Techwatch, or third parties carefully selected by Techwatch.
  11. Shipping of the printed magazine is limited to the Netherlands and Belgium.
  12. Premium membership is valid until further notice, taking into account the notice period of one (1) month after the first year.
  13. It is not possible for companies to take out a Bits&Chips Premium membership. As a company, you can only opt for the Bits&Chips Business membership.

Article 1.9.3: Bits&Chips Premium Plus membership

  1. Bits&Chips Premium Plus membership is intended for private individuals.
  2. The applicable membership rate of Bits&Chips Premium Plus membership can be found on the Bits&Chips website (www.bits-chips.nl) and in the magazine.
  3. Member must complete the entire registration form.
  4. Bits&Chips Premium Plus membership provides further specified benefits, which are only valid if the personal data are entered correctly. If the information is incorrect, Techwatch is entitled to send an additional invoice.
  5. Members receive the printed magazine at the specified private address and/or receive the digital magazine at the specified e-mail address.
  6. Members receive a personal login to gain access to the complete article and video archive on the Bits&Chips website (www.bits-chips.nl).
  7. This login is strictly personal and may not be shared. Reasons for this are: 1) that the login serves for identification when logging in and 2) because the linked account contains personal data, such as information about this subscription and personal information about the subscriber (e.g. e-mail address and payment details).
  8. Members of Bits&Chips Premium Plus membership receive one (1) discount code per person per year for access to all Bits&Chips-events and High-Tech Systems events. This discount code is personal and non-transferable. The discount code can be exchanged once (1x) per event for a discount determined by Techwatch. This discount may differ per event.
  9. Techwatch determines how many High-Tech Systems events and Bits&Chips events are organized each year. Techwatch determines each year how the organization of the High-Tech Systems events and Bits&Chips events is designed. Numbers, content and themes are subject to change and no rights can be derived from this.
  10. The discount codes for the High-Tech Systems events and Bits&Chips events will be sent to the member by e-mail prior to the event in question.
  11. It is the member’s responsibility to make a correct email address available to Bits&Chips at all times.
  12. No rights can be derived from discount codes that have not been received properly or on time by the member. Techwatch is not liable for any consequences of discount codes not being received or received too late.
  13. Once a year, members must check their registration details in My Account for accuracy.
  14. Members agree to receive (e-)mailings from Techwatch, or third parties carefully selected by Techwatch.
  15. Shipping of the printed Bits&Chips magazine is limited to the Netherlands and Belgium.
  16. This membership is valid until further notice, taking into account the notice period of one (1) month after the first year.
  17. It is not possible for companies to take out a Bits&Chips Premium Plus membership. As a company you can only opt for the Bits&Chips Business membership.

Article 1.9.4 Bits&Chips Business membership

  1. Bits&Chips Business membership is intended for companies.
  2. The applicable membership rate for Bits&Chips Business membership can be found on the Bits&Chips website (www.bits-chips.nl) and in the magazine.
  3. Members must complete the entire application form.
  4. Bits&Chips Business membership provides further specified benefits, which are only valid if the company data are entered correctly. If the information is incorrect, Techwatch is entitled to send an additional invoice.
  5. Members receive the printed magazine at the company address specified when applying for a Business membership and/or receive the digital magazine at the e-mail addresses provided.
  6. Business membership entitles all accounts on your company e-mail domain to Premium Plus access. Employees with a valid e-mail address can create a login on the Bits&Chips website via a special link to gain access to the complete article and video archive on the Bits&Chips website (www.bits-chips.nl).
  7. This login is personal and may not be shared. Reasons for this are: 1) that the login serves for identification when logging in and 2) because the linked account contains personal data, such as information about this subscription and personal information about the subscriber (e.g. e-mail address and payment details).
  8. Business members of Bits&Chips receive one (1) discount code per company employee per year for access to all Bits&Chips events and High-Tech Systems magazine events. These discount codes are company employee specific and non-transferable. The discount code can be exchanged once (1x) per event for a discount determined by Techwatch. This discount may differ per event.
  9. Techwatch determines how many High-Tech Systems events and Bits&Chips events are organized each year. Techwatch determines each year how the organization of the High-Tech Systems events and Bits&Chips events is designed. Numbers, content and themes are subject to change and no rights can be derived from this.
  10. The discount codes for the High-Tech Systems events and Bits&Chips events will be sent to the Business member employee by e-mail prior to the event in question.
  11. It is the member’s responsibility to make a correct e-mail address available to Bits&Chips at all times.
  12. No rights can be derived from codes that have not been received properly or on time by the member. Techwatch is not liable for any consequences of discount codes not being received or received too late.
  13. Once a year, Business members must check their registration details for accuracy.
